Legal proceeding costs explained

Waipā District Council Chief Executive Steph O’Sullivan says the costs associated with recent legal proceedings following unacceptable online behaviour directed at a staff member were higher than expected, but the Council had a clear obligation to act.

Her comments come following commentary circulating on social media regarding costs for the legal proceedings. The total cost was $88,343.15 including GST.

O’Sullivan said the decision to proceed with a legal case was not made lightly.

“We sought advice and made the decision to bring the proceedings to ensure the Council met its legal obligations, in particular under the Health and Safety at Work Act.”

As Chief Executive, she was charged with making decisions every day to ensure the Council was adhering to legislation across many complex fields.

“This is not a situation we wanted to find ourselves in, but we cannot be responsible for the actions of others. We can, however, make sure that as a good employer we do all we can to protect the health, safety and wellbeing of staff, and the reputation of Council,” she said.

“This was a complicated and challenging case. Due to the ongoing nature of the situation, it took some time to reach a resolution.

“The court provided the outcome sought and I take heart from that as it sends a clear signal unacceptable online behaviour will not be tolerated. We now consider the matter closed.”
