Appeal against Newcombe Road quarry withdrawn

An appeal against a resource consent for a sand quarry in Newcombe Rd, Cambridge, has been resolved through a meeting between the applicant R S Sand Limited and the appellant, Mr Rhys Powell.

Group manager district growth and regulatory services, Wayne Allan, said that the council was notified of the outcome on Thursday. It means no hearing will now be required in the Environment Court.

“We understand the meeting was productive, and a compromise was reached which was acceptable to both parties,” he said

“That means the original decision to grant the sand quarry consent stands.”

The consent, granted by independent hearing commissioners followed a joint hearing on behalf of Waipā District and Waikato Regional Councils, will allow RS Sand Ltd to extract up to 400,000 tonnes of sand per year under strict and enforceable conditions designed to protect neighbours, local roads, and the environment.

Allan said it is expected that the Environment Court will notify all parties of the appeal withdrawal and issue a formal procedural order confirming that the Court proceedings are at an end and that the resource consent decisions remain unchanged.
